Aim: An advanced course for practitioners and those that assess mental capacity. This will give a caselaw update from the court of protection.

Outcomes: Looking at the legal protection of section 5 and 6 of the MCA and their importance
Court of Protection – Notable case law examples. •Please include new / recent case law updates and the learning taken from these.
MHA/MCA interface. Assisting a person to make their own decisions-Principle 2 and Case Law to support. Consent to Treatment, Valid Consent, supported decision-making and legal authority if no consent.
Best Interests and its importance when managing making decisions for others Acting lawfully in someone’s best interest. The importance of involving the person and significant others in the BI decision-making. Case study-P lacks capacity-consider balance sheet approach. Highlight CoP case law demonstrating good practice. Role the IMCA or Advocacy.
Consider restrictions/restraints within the MCA when it is appropriate & lawful, Explain the limits on power and control in health / care setting. Distinction between restraining a person & taking away a person’s liberty. Care Planning and lawful restrictions.
Court of Protection and its role to explore making decisions in disputes or complex circumstances regarding.
MHA/MCA interface Treatment scenarios including physical, exclusions to treatment for mental disorder, CTO, Anorexia Nervosa, and medical treatment by force. . Also briefly consider community powers of the MHA and their relationship with DoLS.
